brown and white brown and white bethlehem pa tuesday february 13 it7t ex-cadets plead guilty to fraud by lee ann lusardi in grade scandal two former university students pleaded guilty friday in federal court to charges of conspiring to defraud the government in the 1977 grade-changing scandal david w atherholt 22 of coopersburg and david s kaminski 22 of allentown were placed on five years probation and ordered to pay back 8,000 each for money received over two years from the united states air force reserve officer training program afrotc according to the allentown morning call the afrotc program paid the students tuition and book costs as well as 100 a month the men were charged with breaking into professors offices replacing their original examinations with new ones with correct answers altering grade books and breaking into the registrar's office to place false grade cards on their records the grades of three other men also were changed the three have since withdrawn from the university however kaminski and a ther holt's involvement with the afrotc program prompted an fbi in vestigation into ttie matter and the two men's subsequent federal grand jury in dictment the men's counsel easton atty mark refowich made a plea bargain with u.s asst atty gary tillis according to tbe morning call the former students were sentenced as youthful offenders and or dered to make restitution to the federal government within three years further the two men can petition the court to ex punge the record at the end of the five-year probation period the men could have been sentenced to up to five years imprisonment and 10,000 in fines registrar's safe entered formerly completed grade cards from professors were received at the registrar's office assembled in piles by grade and sent to the control group to be fed into the computer according to a 1977 interview with registrar james wagner in the spring of 1977 registrar office employees noticed that the cards which were kept in ttie safe until au grades were in were not flush indicating someone had tampered with them in some cases the grade on an original grade card waa changed and the professor's initials forged next to the correction austin gavin executive consultant to the president said at the time the scandal broke in other cases counterfeit grade cards were substituted for the real ones changes in the grade-handling procedure have bean made to prevent a recurrence of the grade-changing wagner said yesterday about 20 altered grades were found in the registrar's office and several more were discovered when professors verified their spring 1977 grades in some cases the students had not attended or taken exams in several courses wagner said at the time the professors in several of the courses had never heard of the students whose grades were changes letter prompts investigation university administrators first heard of possible grade falsification in may 1977 when an anonymous letter was sent to university president deming lewis dean of students william quay associate dean of students robert reeves and university registrar james wagner the letter stated students are buying grades for up to 100 a grade it did not contain names or details employees in the registrar's office subsequently noticed misplaced articles in the office according to austin gavin executive consultant to the president for example the grade cards on which professors record students grades war ia the wrong order he said the university than rechacked all students grades for the preceding several semesters austin gavin sac publicity chairman faces impeachment hearing by jim morrison student activities council sac publicity chairman jay yanavok 81 has been charged with five violations of two separate articles of the sac constitution the charges were distributed to sac members at their meeting on friday an impeachment hearing wiu be held at 4:15 p.m wednesday in the university center the hearing had been scheduled for sunday but was postponed at friday afternoon's sac meeting the impeachment trial procedure to be used tomorrow was adopted at a special meeting of the council jan 25 yanavok was impeached at a dec 6 sac meeting a list of the charges against yanavok was distributed to council members at their friday's meeting a brown and white reporter was denied access to a copy of the charges nathan harris assistant dean of students told ttie reporter the document was not for the public a copy of the charges obtained by the brown and white lilts violations of two articles of the sac constitution the first charge comes under article iv section 6 of the constitution which says the publicity chairman shall organize and supervise the operation of the publicity committee be responsible for the initiation and operation of publicity . and execute contracts for the council per taining to publicity the charges allege that the publicity committee has been unstable under mr yanavok's supervision many members have been lax in their duties to properly publicize sac events a list of five instances in which the council publicity was allegedly inadequate fouowed included in the list were movie series publicity alleged mistakes in the sac's hot line publicity for the movie yessongs and a coffeehouse and alleged failure to provide proper publicity for a coffeehouse co-sponsored with the catacombs also the charges alleged that mem bers of the publicity committee have become disenchanted and their per formance has deteriorated over the semester no action has been taken by mr yanavok to correct the situation the second part of the charges deals with article iv section 14 of the con stitution which states in part all members of the council shall uphold the spirit as well as the letter of this con stitution perform such duties as prescribed by this constitution and the parliamentary authority adopted by the council the charges said yanavok filibustered the oct 17 sac meeting and disrupted another meeting by walking out in the middle of a serious discussion also listed under violations of this article was the deteriorated relationship of other members and yanavok and his attempt to create a scandal concerning the movie fund inaccuracies the charges concluded that mr yanavok has created more negative publicity for the council than positive a resolution to impeach yanavok was passed 11-1 at the dec 6 meeting of the sac a decision regarding the guilt or innocence of the person charged is done by secret ballot of the other 11 members and requires a two-thirds vote of the council disciplinary action including removal from office alto requires a two-thirds vote tuition coverage of educational bill varies by student by jim
