* y * ARTICLES OP AGREEMENT made and entered into this ninth day of February A.D. One thousand eight hundred and eighty-five(1885), between ELISHA A. PACKER of the City of New York, party of the first part, and THE SILVER BROOK COAL COMPANY. a corporation formed under the laws of the State of Pennsylvania, party of the second part,- W I T N E S S E T H*r I. That the 3aid party of the first part for and in consideration of the rents or several sums of money to he paid and the covenants and agreements to he kept and performed on the part of the said party of the second part, and hereinafter more particularly set forth, has and hereby does demise, grant and let unto the said party of the second part, the exclusive right and privilege for the term of thirty-five (35) years from February first, eighteen hundred and eighty-five (1885), until the first day of February, nineteen hundred ad twenty(1920), to dig, mine, prepare and take away fossil or mineral coal wholly at their own cost and expense, and for their own use and benefit, in and from all the beds or veins of coal in and on all the tracts or parcels of land belonging to the said party of the first part as per map hereto attached, and described as follows:- BEGINNING at stones the North West corner of the William Kel - vey and in the East line of the Paul Baulty tract; thence by said Baulty tract North thirty degrees fifteen minutes West three thousand seven hundred and'eight f§et to stones the North East corner of BaulJ^ and a corner of Martin Diehl tract, thence by said I>iehl tractAfour degrees thirty minutes West two htondred and fifteen feet to a pine; thence North eighty-three degrees forty minutes East, nine thousand five hundred and thirty feet to stones in the East line of the Christian Kunkle tract, thence by said Kunkle tract South six degrees thirty minutes East, six hundred and three feet to stones, corner of Kunkle, Daniel Hurley and William M*Adams tracts, thence by said M'Adams and aforesaid Kelvey tracts, South sixty- three degrees eighteen minutes West, eight thousand five hundred and seventy feet to the place of beginning- CONTAINING Four hundred and fifty three Acres and One hundred and thirteen perches strict measure; the said lands being SITUATE partly in Kline Township, (formerly Rush Township), Schuylkill County, and partly in Lausanne Township, Carbon County, and State of Pennsylvania, and known as the "Andrew Grove" tract, more particularly described in a deed from the Lehigh Valley Railroad Company to the said Elisha A. Packer, party of the first part hereto, dated January thirty-first,A.D. 1885, and recorded in the office for Recording Deeds, &c, in and for Schuylkill County, Pennsylvania, in Deed Book No. 178, page 263, and in the office for Recording Deeds &c, in and for Carbon County, Pennsylvania, in Deed Book No. 30, page 13 &c. II. And the said party of the first part hereby further demises, grants and lets unto the said party of the second part all of the surface of the above described property, as well as the exclusive right and privilege of cutting and taking away trees and timber from, and depositing dirt, slate and coal upon the above described tracts or pieees of land. The said timber and trees to be used only for their mining purposes on said tracts or pieces of land, including erection of breakers, machinery and fixtures for mining and taking coal from the said land and preparing it for market, and the necessary buildings for houses, breakers, slopes, &c. And the said party of the second part shall take, hold and enjoy the privileges hereby granted and subtest to the following covenants, terms, payments, reservations, conditions, restrictions, and regulations, to wit:-
