cation and if the course of instruc tion and standard of admission to said institution and the composition of the faculty shall appear to said council to be sufficient and the educational needs of that particular locality in which the proposed insti tution is to be situated and of the commonwealth at large are likely to be met by the granting of said application the said council shall thereupon cause to be endorsed on said application a certificate of its findings and its approval of the same together with a recommenda tion to the law judge or court be fore whom the same was originally presented that the same be granted if in the judgment of the council the said application should not be granted it shall endorse thereon its findings and its disapproval of the same with a recommendation that said application be refused the said certified copy of said certificate shall with the endorsements there on thereupon be returned to the said law judge or court who in fin ally passing upon the application shall be guided in his decree by the finding of the college and univer sity council in case of the disapproval of said application by the council aforesaid the pro posed charter shall not be granted it will be recognized that this is a very wise system of regulation pre venting the starting of poorly equipped and incompetently man aged institutions pretending to be institutions of higher learning whose degrees might become a by word and a reproach president drinker was appointed a member of this council some years ago by the governor and upon the expiration of his first term has just been re-appointed a mem ber of the council the council has before it at the present time two important applications for amendment of charter from col leges of pennsylvania which have been referred to committees one of which dr drinker is a member for consideration and report dr drinker was absent in pittsburg on friday and saturday of last week on this business meeting of musical as sociations the first meeting of the orchestra was held on friday evening ow ing to the number that reported the outlook for the coming year is a promising one the mandolin club met sunday afternoon at three o'clock about fifteen men were present the joint musical association will play at the y m c a reception in drown hall on saturday evening all candidates for the university band should report for practice on wednesday at 1 o'clock in drown hall new foot-ball captain at a meeting of the foot-ball team held sunday afternoon in drown hall c b lawson tender ed his resignation as captain and a g black was elected to fill that position for this year's team l dunning to was in town the past few days in these days of unrest in regard to the alleged influence of corporate monopoly it is interesting to note that the states of new york and pennsylvania in two marked in stances have placed their stamp of approval on the institution of com missions to prevent undue expan sion and disastrous competition a number of years ago the state of new york in its regulation of the railroad interests of the state gave to its railroad commission the power to forbid the building of a new railroad if in the opinion of the commission the locality to be traversed did not require the addi tional facilities proposed at the bottom of this principle was the sound idea that the unnecessary multiplication of railroads and the waste of money incident thereto should be carefully regulated in pennsylvania a somewhat sim ilar position was taken fifteen year ago — in 1895 — by the legislature in the institution of the college and university council this act approved june 26 1895 is intended by its title to provide for the incorporation of institutions of learning with power to confer degrees in art pure and applied science philoso phy literature medicine law and theology and for the supervision and regulation of the same and providing a method by which in stitutions already incorporated may obtain the power to confer degrees the act then goes on to state the minimum requisites which must be offered in the way of endowment and faculty in the institution of any new college or university and pro vides further that any existing col lege desiring an amendment of its charter must conform to these re quisites it then provides that any petition thereafter presented to the courts for the incorporation of such a college or university or for amend ment of charter must before it is granted be referred to a council to be styled the college and univer sity council consisting of twelve persons — the governor of the commonwealth the attorney gen eral the superintendent of public instruction three presidents of un denominational colleges or universi ties three presidents of denomina tional colleges or universities and three persons holding official rela tionship to common schools of the state it was made the duty of the coun cil to hear and consider said appli ! the brown and white lehigh university bethlehem pa tuesday october 11 1910 dr drinker reappointed member of college and university council dr estes ends his talk to students lehigh--stevens play tie game vol xviii new rules an important factor in hard-fought contest governor stuart recognizes the efficient service of lehigh's president addresses large audience on the conservation of life friday at 11 a m dr william l estes concluded his lecture on the conservation of human life the first half of which was delivered the preceding friday in the course of his lecture dr estes spoke of some of the causes of shortened lives he spoke of certain diseases which have a de teriorating effect upon our lives and general health ; and he told us how these diseases may to a great ex tent be avoided 11l health in adult life is often brought about by excesses practiced during our youth dr estes also touched upon race suicide so marked at the present time in england and france and he showed that if it were not for the great number of emigrants which land on our shores that our country would be in the same con dition his lecture was very beneficial and instructive that it was appre ciated by those who heard it was clearly shown by the applause which followed its conclusion meeting of the arcadia the arcadia met on thursday evening for the election of members at-large from the senior class to that body the following men were elected : f s borden j r dawson and g r wood these men were elected with the follow ing provision : that should they be elected to any position entitling them to further membership to the arcadia that their places as mem bers-at-large be filled by another election from the senior class the following committees were appointed : haverford smoker — j h graybill a p spooner and l c wright lehigh song book a priestly f s borden and b s thompson lehigh met stevens on saturday for the second game of the season a good sized crowd witnessed the game and saw an excellent example of the new game of foot-ball much use was made of the open game and lehigh lost her one chance to score on account of the new rules both teams showed proficiency in the use of the forward pass but lehigh proved the superior the game follows : lehigh received the first kick-off at the eastern end of the field and after an exchange of punts secured the ball on her 35 yard line a for ward pass heard to rouse gained 35 yards wood added 10 more on the same play and cox 25 more on another three line plays took the ball to stevens 5 yard line where a forward pass went straight into the arms of a stevens man stevens kicked out of danger and lehigh was penalized half the distance to her goal heard's kick was blocked but he recovered the ball as time was up the second quarter was an ex change of kicks and attempted for ward passes the ball see-sawing back and forth with neither goal in danger with the exception of cox a new backfield started the third quarter for lehigh stevens kicked off to donaldson who came back to the 30 yard line again as in the sec ond quarter there was an ineffect ual exchange of kicks and forward passes stevens could do nothing with lehigh's line and most of her forward passes were intercepted or thrown with little or no gain lehigh's original back/field came back for the last quarter which opened with the ball in lehigh's continued on fourth page foot-ball songs wanted anyone writing a verse and chorus suitable for a foot-ball song to the music of one of the latest compositions is asked to hand it to the committee on songs consisting of thompson borden and priestly as soon as possible no 5 notice subscriptions for the brown and white if paid before novem ber 1 will be 1.50 otherwise 2.00 per year these may be mailed to 430 seneca st south bethlehem pa or paid in the brown and white room drown hall wednesday and saturday af ternoons from 2 to 3 o'clock
