lehigh university brown and white vol 88 — no 46 bethlehem pa friday april 22 1977 by donna frabotta senior reporter fishkin suit settled out of court the 21-million mitch fishkin suit against the university tuesday was set tled out of court for an undisclosed amount the brown and white has learned that previously reported figures by a local newspaper of 25,000-$60,000 are correct william quay dean of students and a defendant m the suit also would neither confirm nor deny the settlement figures quay said he must remain silent because the judge ordered that the settlement figure could not be disclosed university attorney robertson taylor said unfortunately we are duty-bound not to reveal what the arrangements were this is for the benefit of the fishkins and the university the settlement was reached after nearly 20 hours of closed meetings among at torneys for both sides and judge e mac troutman m the u.s district court m reading the all-male jury selected friday stood by to hear the case if negotiations failed the settlement marks the end of nearly three years of legal action the suit was initiated m september 1974 by seymour fishkin the university student's father mitch fishkin 19 died from multiple mitch fishkin highrise tied to signing of aggreement by peg pfenninger construction on the proposed 5 million plaza highrise complex to house university students on the site of the university-owned college theater on w 4th street will begin when the university signs a lease-back agreement with the developers according to jim mccarthy of the bethlehem city planning office mccarthy said the university and the city have been negotiating the develop ment project five months with south mountain inc developers he would not say when the university will sign the lease-back agreement eric ottervik vice president for plan ning had stated april 4 that the university and the developers would come to an agreement by april 14 since the negotiations have gone beyond that time period the highrise will probably not be ready for student occupancy m september 1978 as first projected mc carthy said the college theater is part of a nine block area that is subject to city control site plan reviews mccarthy said the highrise would be outside the university's sac candidates discuss promoters programming by caryn gorbunoff £ candidates running for top student activities council sac posts have ex pressed differing attitudes about the amount of emphasis which should be placed on sac activities and programs next year candidates for president are mike rayhill 78 and chuck heller 78 present vice president contenders for the position of concert chairman are incumbent gary hirschberg 78 dan tilles 78 jordan garrison 78 and karen wilhelm 80 the presidential candidates hold op posing views on sac responsibility rayhill said he favors bigger concerts and the use of a promoter while heller said he would stress that the sac take m a full scope of student interest heller said he is also m favor of diversified programming such as more activities including all students trustees to be called upon in pp&d library resolution by sue chodakewitz the university board of trustees will be called upon m a resolution of the forum priorities planning and development committee pp&d the resolution to be presented at the may 2 forum meeting urges the board of trustees to recognize the essential role that the library plays m lehigh university and suggests several priorities to be adopted the resolution advocates the formation of a program committee to ensure the speedy implementation of the priorities cited it further requests the forum's inclusion m this committee m view of the instrumental role it has played up to this point the resolution is the result of pp&d's work on problems facing the university regarding library inadequacies the problem has been divided into three parts m a report prepared by pp&d the bruce rosenthal officers note forum achievements by jerry miller the securing of forum input m ad ministrative hiring was one of the most important accomplishments of forum vh according to its executive officers in separate interviews they agreed the legislation giving the forum the right to consult with the administration m appoint ments to the rank of dean or above was a major success for the forum mike exstein 77 forum vh vice chairman said the forum's foremost accomplishment m 1976-77 was simply surviving characters and personalities created problems which were com pounded by absenteeism and a lack of faculty involvement he explained both he and hildy shandell 77 forum vii secretary-treasurer said they thought the forum was too student-oriented the faculty allows the students to dominate the organization which fosters further faculty apathy exstein said who characterized it as a vicious cycle the priorities planning and development committee's analysis of the university's library system is the best in depth study the forum has done m a number of years exstein said forum vh chairman david amidon lecturer m urban studies also praised the study he said it illustrates well the real purpose of the forum amidon and shandell praised forum involvement m creating the new lottery system for campus housing however shandell said the lottery does not solve the housing problem it only provides a means of coping with it exstein also praised forum vll's in volvement m campus lighting security residence halls and dining services the forum has ineffective input m budget decisions according to exstein and shandell the forum is not involved m the gut-level decisions where expenditures are decided exstein said shandell expressed concern that the university may be pricing students out of the institution we're exclusive enough
