former lehigh student josoph henry and attorney j michael farrell have filed more than 100 challenges to either dismiss the april 1987 death sentence or receive a new trial for henry the post-trial hearing has been continued from feb 2 until march 1 to allow the defense counsel more time to prepare its legal arguments the hearing originally was scheduled for october 1986 but continuances and delays in the trial process postponed it to this date the hearing allows the defense counsel to enter legal questions on the trial following the post-trial hearing which ends with the formal sentencing of henry the defense will begin the first of several appeals through the state court appellate system the state supreme court pennsylvania's highest court of appeals automatically hears appeals by any criminal defendant receiving the death sentence henry was convicted april 25 of first-degree murder in the strangulation of lehigh freshman jeanne ann clery on april 5 1986 the jury sentenced henry to death by the electric chair on april 28 1987 for the crime franciosa who presided over the trial is also presiding over the post-trial currently henry is waiting in the county jail for formal sentencing after which he will be transported to the maximum security state prison at graterford where he will remain for the rest of the appeals process the 113 arguments for a new trial or overturning the death sentence challenge many of the trial's proceedings the defense counsel's appeal said the court denied henry a pre trial plea to bar the imposition of the death sentence in the event that he was convicted this would have allowed the jury to give only life imprisonment as its highest sentence rather than the death penalty when he was found guilty the defense counsel also argues in the appeal that the denial of a pre-trial motion for a change in venue did not result in a fair trial a change in venue would have allowed the court to hold the trial in another county that other executive officers elected include junior kevin perry of pi lambda phi fraternity as vice-president junior brian briggs of chi psi fraternity as treasurer sophomore thomas neff of lambda chi matt deutscher of phi kappa theta as judicial chairman the new president of the ifc is a member of alpha tau omega fraternity and is the outgo ing ifc secretary in his address thursday evening eichman outlined his two main goals for the upcoming year the first was to oversee a smooth transition for all fraternities concern ing the proposed social policy the second involved the strengthening of the ifc the members of the greek system make up a large percentage of the school's popula tion by looking at the numbers it's obvious that the ifc has potential that is still untap ped eichman said perry a former gryphon expressed interest in improving the greek image through fund raisers and charity drives by individual chap ters and by the ifc he also said he believes fraternities must work together for the ifc to succeed and is adamant about keeping in contact with chapter presidents you don't have to be on ifc to have an impact there are plenty of good ideas that should come to ifc's attention that never get channeled back i think people should be able to have their ideas heard perry said in other business it was announced that the bed races held during greek week will be moved to the murray h goodman campus the announcement sparked a debate between dean of students john smeaton and chapter representatives who will soon meet to discuss the planned move a second announcement a plan dealing with the lehigh judicial system the newly revised judicial system created as an educational process seeks to allow students greater options despite the absence of profes sional legal council disclosure of names of students involved and the closing of disciplinary meetings to the press according to associate dean of students terrence curran the university hearing process is supposed to be based on educational principles said curran we are not here to prosecute people punitively because of transgressions we try to help them in terms of education to learn what it takes to be a positive member of society the judicial system of which curran is chief judiciary officer is an 18 mo nth-old revision characterized by assistant vice president and dean of students john smeaton as very fair as compared to the old system smeaton said the current system ail see judiciary page 7 the judicial process this friend can be a student faculty member or any other member of the lehigh commun ity according to smeaton the reason for the university friend is to see that j the student is given a fair trial we do not want the fact that the student may be nervous to impede the progress or fairness of their hearing ows for greater protection for the accused and a much quicker disposi tion of cases he also said the process is designed to be more educationally based rather than on punitive punish ment the new gustice system is substan tially better than the old because it allows for more options for the stu dent explained smeaton in the old system due process complaints were a student's only avenue for appeal the revision allowed for students to appeal any part of the process they feel is unfair or biased the new system also allows the accused party a choice between an administrative
