previous semester in a grading dispute with creighton delaney chair person of the art department delaney had instructed hillis to carry a student kelly perkins for advanced placement in his classes and to give her a b grade hillis refused to do so and after he gave perkins a grade witheld delaney had the grade changed to a b in 1982 the university was able to convince the u.s sth circuit court of appeals that the grading dispute was not the reason why hillis contract had not been renewed and his suit for reinstatement and back pay was denied even though the issue was not used as a basis in the court's decision the court added some strong language that indicated little respect for a professor's discretion in grading matters while academic freedom is well recognized circuit judge charles
